Kuwait : Kuwait has introduced new regulations affecting the hiring and employment of expatriate workers, aiming to enhance labor market integrity and prioritize opportunities for Kuwaiti nationals.
Key Measures Implemented:
Pre-Approval for Certain Job Categories: The Public Authority for Manpower (PAM) now requires employers to obtain pre-approval for specific job categories before applicants can proceed with security clearance from the Ministry of Interior. This measure primarily targets positions necessitating security vetting.
Suspension of Changes to Academic Qualifications and Job Titles: Ministerial Circular No. 1/2025, issued by the Minister of Defense and Acting Minister of Interior, has suspended modifications to academic qualifications and job titles for expatriate workers. This suspension applies to those recruited on work permits or transferred to the private sector, particularly when proposed changes involve higher academic qualifications that do not align with the nature of the original job role.
Development of a Unified Job Classification Guide: PAM has been tasked with creating a Unified Kuwaiti Guide for Job Descriptions and Classifications. This guide aims to standardize job titles and qualifications across sectors, ensuring consistency and preventing discrepancies between a worker’s academic credentials and their actual job role.
Implications:
For Expatriate Workers: The new regulations may affect those seeking to upgrade their qualifications or change job titles, especially if the changes are incompatible with their original job roles.
For Employers: Companies must ensure that job roles and academic qualifications are accurately matched from the outset. They should also stay informed about the forthcoming Unified Job Classification Guide to maintain compliance with the new standards.
These reforms reflect Kuwait’s commitment to regulating its labor market, promoting merit-based hiring, and expanding job opportunities for its citizens.
